These Terms of Service ("Terms") govern your use of getamplifye.com and the services provided by Amplifye. By using our Site or services, you agree to these Terms. If you do not agree, please do not use our Site or services.

1. Description of Service

Amplifye provides a done-for-you AI automation platform that captures leads, books appointments, and sends automated SMS and email follow-ups on behalf of local service businesses. Services include, but are not limited to, lead auto-response, smart scheduling, missed call text-back, appointment reminders, review requests, and re-engagement campaigns.

2. Pricing

Amplifye pricing varies by client, trade, and scope of services, and is set out in each client's individual service agreement. Pricing is subject to change with reasonable advance notice to active clients.

3. Payment Terms

Subscription fees are billed monthly and are due on each monthly anniversary of your subscription start date. Failure to pay may result in suspension or termination of services.

4. Cancellation Policy

Either party may cancel services by providing 30 days' written notice to the other party. Services and billing will continue through the end of the 30-day notice period.

5. SMS Messaging Terms

By providing your phone number and opting in, you consent to receive SMS messages from Amplifye. Message and data rates may apply. Message frequency varies. Reply STOP to opt out at any time. Reply HELP for help.

SMS opt-in consent is specific to the program you opted into and is not shared, sold, or transferred to any third party for marketing or promotional purposes. See our Privacy Policy for full details on how mobile information is handled.

6. Acceptable Use

You agree not to use Amplifye's services to send unlawful, abusive, deceptive, or unsolicited messages, or to violate any applicable telecommunications, marketing, or consumer protection laws, including the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act. You are responsible for obtaining proper consent from your own customers before Amplifye sends communications on your behalf.

7. Limitation of Liability

To the fullest extent permitted by law, Amplifye shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, our services. Our total liability for any claim arising out of these Terms shall not exceed the amount you paid to Amplifye in the three (3) months preceding the claim.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law principles.

9. Changes to These Terms

We may update these Terms from time to time. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
